1. Introduction

This Privacy Policy describes how Vietnam WayFinder (“Vietnam WayFinder”, “we”, “us” or “our”) collects, uses, discloses and safeguards personal information in connection with the Vietnam WayFinder website and applications (together, the “Service”).

This Policy applies to all users of the Service. Please read it carefully. By accessing or using the Service, you acknowledge that you have read and understood this Policy.

2. Who we are

Vietnam WayFinder operates vietnamwayfinder.com and is the party responsible for personal information processed in connection with the Service.

3. Information we collect

We collect the following categories of information:

  • Account information. Information provided when you register for an account, including your name and email address. Where you register using a third-party sign-in provider, that provider supplies your name, email address and basic profile information.
  • Preference information. Optional information you elect to provide regarding your interests and the types of places, food, drink, accommodation and activities you prefer, together with the places you save within the Service. This information may be amended or cleared by you at any time.
  • Submitted content. Content you submit to the Service, including suggestions, text and photographs, together with associated metadata.
  • Correspondence. Information you elect to provide when contacting us, including through any contact form made available on the Service.
  • Technical information. Information transmitted by your device and browser in the ordinary course of accessing the Service, including connection information and general location.

4. How we use information

We use personal information for the following purposes:

  • Establishing, maintaining and administering user accounts
  • Operating, maintaining, securing and improving the Service
  • Publishing and displaying content submitted to the Service
  • Personalising the content and ordering of material presented to you
  • Sending administrative, security and service-related communications
  • Sending optional communications where you have elected to receive them
  • Responding to enquiries and correspondence
  • Understanding usage of the Service on an aggregate basis
  • Preventing, detecting and addressing fraud, abuse and violations of our Terms of Service
  • Complying with applicable legal and regulatory obligations

5. Legal bases for processing

Where the General Data Protection Regulation or the UK GDPR applies, we process personal information on the following bases: the performance of our contract with you; your consent, in respect of optional information and optional communications, which may be withdrawn at any time; our legitimate interests in operating, securing, improving and sustaining the Service; and compliance with legal obligations.

6. Information visible to others

Content published on the Service is displayed together with an attribution byline. You determine the form of that byline. Your surname is not displayed in full, and your email address is not displayed. Other account information is not made public.

7. Service providers

We do not sell personal information, and we do not share it with third parties for their own purposes.

We do rely on established service providers to operate the Service, including for database, storage, hosting, authentication, email delivery, domain, content delivery and media services. These providers process information solely on our instructions and solely in order to provide those services to us. Certain providers deliver content directly to your browser and accordingly receive your IP address when pages are loaded.

We may also disclose personal information where we consider it necessary to comply with applicable law, to respond to lawful requests from public authorities, to enforce our Terms of Service, to protect our rights, property or safety or those of others, or in connection with any merger, acquisition, financing or sale of assets.

8. International transfers

The Service is operated from Vietnam, and our service providers operate from various jurisdictions, including Singapore, the United States and the European Union. Personal information may accordingly be transferred to, stored in and processed in countries other than your own, including countries outside the European Economic Area.

Where such transfers occur, we rely on the contractual protections and transfer mechanisms offered by the relevant providers. Further information is available on request.

9. Cookies and similar technologies

We do not use cookies or similar technologies for advertising or analytics. Our service providers may set strictly necessary cookies required for sign-in, security and the delivery of the Service.

10. Advertising

The Service may carry advertising and sponsored placements. Advertisers do not receive your personal information from us.

11. Retention

We retain personal information for as long as necessary for the purposes described in this Policy, including for the maintenance of your account, and thereafter as required to comply with legal obligations, resolve disputes and enforce our agreements.

Content published on the Service is retained on an ongoing basis, as described in our Terms of Service.

12. Your rights

Subject to applicable law, you may request access to the personal information we hold about you, request that it be corrected, request its deletion, object to or request restriction of certain processing, withdraw consent previously given, and request a copy of your information in a portable format. You may also elect at any time not to receive optional communications.

Where the General Data Protection Regulation, the UK GDPR or the Law on Personal Data Protection of Vietnam applies, you may in addition lodge a complaint with your competent supervisory authority.

Requests may be submitted to hello@vietnamwayfinder.com. We will respond within the period required by applicable law and in any event within 30 days.

13. Account deletion

You may delete your account within the Service, or request deletion by contacting us at hello@vietnamwayfinder.com from the email address associated with your account.

Content previously published on the Service is retained following deletion of an account and is displayed under our default attribution, the generic byline “WayFinder”, which does not identify you.

14. Children

The Service is intended for persons aged 16 and over. We do not knowingly collect personal information from persons under that age. If you believe that a person under 16 has provided personal information to us, please contact us and we will take appropriate steps.

15. Security

We maintain administrative, technical and physical safeguards designed to protect personal information, including encryption of data in transit and at rest by our storage provider. No method of transmission or storage is entirely secure, and we cannot guarantee absolute security.

16. Changes to this Policy

We may amend this Policy from time to time. The date at the top of this Policy indicates when it was last revised. Where changes are material, we will provide notice through the Service or by email prior to the changes taking effect.

1. Acceptance of these Terms

These Terms of Service (“Terms”) govern your access to and use of the Vietnam WayFinder website and applications, together with all content and functionality made available through them (the “Service”).

By accessing or using the Service, or by registering for an account, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated by reference. If you do not agree to these Terms, you may not access or use the Service.

2. About us

The Service is operated by Vietnam WayFinder (“Vietnam WayFinder”, “we”, “us” or “our”). We may be contacted at hello@vietnamwayfinder.com.

3. Eligibility

You must be at least 16 years of age to register for an account. By registering, you represent and warrant that you meet this requirement and that the information you provide is accurate and complete.

4. Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity occurring under your account. You agree to notify us promptly of any unauthorised use of your account. We reserve the right to refuse registration, and to suspend or terminate any account, at our discretion.

5. Submissions

You may be able to submit content to the Service, including suggestions, text and photographs (“Submissions”). You represent and warrant that each Submission:

  • Is accurate and based on your own knowledge or experience
  • Consists of material that you own or are otherwise authorised to submit and publish
  • Does not identify any other person without that person’s consent
  • Does not constitute advertising, or promotion of any business in which you hold an interest that has not been disclosed to us
  • Is not unlawful, defamatory, harassing, obscene, discriminatory or otherwise objectionable
  • Does not infringe the intellectual property, privacy or other rights of any person

All Submissions are subject to review prior to publication. We may accept, edit, reject, remove or decline to publish any Submission at our sole discretion, and we are under no obligation to publish, retain or continue to display any Submission.

6. Rights you grant to us

You retain ownership of your Submissions. Ownership does not limit the rights granted under this section.

By making a Submission, you grant us a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, transferable and sublicensable licence to host, store, cache, reproduce, modify, adapt, edit, crop, resize, translate, publish, distribute, publicly display, publicly perform and otherwise exploit that Submission, in whole or in part, in connection with the Service and the promotion, marketing and operation of the Service, in any media now known or hereafter developed.

This licence survives termination of your account and removal of the Submission from the Service. You waive any moral rights you may hold in your Submissions to the extent permitted by applicable law, and you acknowledge that no compensation is or will be payable to you in respect of any Submission.

You further represent and warrant that you hold all rights necessary to grant this licence and that our exercise of it will not infringe the rights of any third party.

7. Attribution

Content published on the Service is displayed together with an attribution byline, the form of which you may select. Our default attribution is the generic byline “WayFinder”, which does not identify you. Where an account is closed, previously published content remains available on the Service under our default attribution.

8. Our intellectual property

The Service, including its selection, arrangement, curation and presentation of content, together with all software, design, text, graphics, logos and other materials provided by us, is owned by us or our licensors and is protected by intellectual property laws.

Subject to your compliance with these Terms, we grant you a limited, revocable, non-exclusive, non-transferable licence to access and use the Service for your own personal, non-commercial purposes. No other rights are granted.

9. Prohibited conduct

You agree not to:

  • Access, copy, scrape, index, harvest or extract content from the Service by automated means, or reproduce or redistribute any substantial part of the Service
  • Use the Service for any commercial purpose not expressly authorised by us
  • Interfere with, disrupt, or attempt to gain unauthorised access to the Service or any related systems
  • Circumvent any access control, rate limiting or other technical measure
  • Reverse engineer, decompile or disassemble any part of the Service
  • Use the Service in violation of any applicable law or regulation
  • Impersonate any person, or misrepresent your affiliation with any person or entity

10. Information on the Service

Content published on the Service is reviewed prior to publication. Information concerning places, businesses and locations is nonetheless subject to change without notice, including in respect of opening hours, pricing, ownership and access, and is provided for general reference purposes.

Recommendations on the Service reflect personal opinion and experience at the time of writing. Inclusion of any place does not constitute an endorsement, guarantee or warranty of any business, its safety, quality or current condition, and we have no affiliation with any place featured unless expressly stated as a sponsored placement.

Nothing on the Service constitutes travel, safety, medical, financial or legal advice. You are responsible for verifying any information on which you intend to rely, and for your own decisions in connection with any place featured on the Service.

11. Third-party content and links

The Service may contain links to, and content served from, third-party websites and services. We do not control and are not responsible for such websites, services or content, or for the practices of their operators. Your dealings with any third party are solely between you and that third party.

12. Advertising and paid services

The Service may carry advertising and sponsored placements. Sponsored placements will be identified as such. We are not responsible for the products, services, representations or conduct of any advertiser, and any transaction between you and an advertiser is solely between you and that advertiser.

Access to the Service is currently provided at no charge. Should we introduce paid features, applicable terms concerning pricing, billing, cancellation and refunds will be published before those features become available.

13. Availability

The Service is provided on an “as is” and “as available” basis. We may add, modify, suspend, withdraw or discontinue any part of the Service at any time without notice and without liability to you.

14. Disclaimer of warranties

To the fullest extent permitted by applicable law, we disclaim all warranties, whether express, implied, statutory or otherwise, including any implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, and any warranty that the Service will be uninterrupted, timely, secure or error-free.

15. Limitation of liability

To the fullest extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, data, goodwill or business opportunity, arising out of or in connection with your access to or use of the Service, whether based in contract, tort, statute or otherwise, and whether or not we have been advised of the possibility of such damages.

Nothing in these Terms excludes or limits liability which may not lawfully be excluded or limited, including liability for death or personal injury caused by negligence, or for fraud or fraudulent misrepresentation. Where you deal as a consumer, these Terms do not affect rights conferred on you by applicable mandatory consumer protection law.

16. Indemnification

You agree to indemnify and hold us harmless from and against any claims, liabilities, damages, losses and expenses, including reasonable legal fees, arising out of or in connection with your Submissions, your use of the Service, or your breach of these Terms or of any applicable law or third-party right.

17. Suspension and termination

You may close your account at any time within the Service. We may suspend or terminate your access to the Service, in whole or in part, at any time and without notice, including where we consider that you have breached these Terms.

Sections which by their nature should survive termination, including sections 5, 6, 8, 14, 15 and 16, shall survive.

18. Rights complaints

If you believe that material available on the Service infringes your copyright or other rights, please contact us at hello@vietnamwayfinder.com with a link to the relevant page, a description of the material, and a statement of the rights you hold. We will review the matter and take such action as we consider appropriate.

19. Changes to these Terms

We may amend these Terms from time to time. The date at the top indicates when they were last revised. Where changes are material, we will provide notice through the Service or by email prior to the changes taking effect. Your continued use of the Service following the effective date constitutes acceptance of the revised Terms.

20. Governing law and disputes

These Terms, and any dispute arising out of or in connection with them or the Service, are governed by the laws of Vietnam. Disputes shall be submitted to the exclusive jurisdiction of the competent courts of Vietnam. Nothing in this section deprives you of protections granted by mandatory consumer protection law in your country of residence.

21. General

These Terms constitute the entire agreement between you and us in relation to the Service and supersede any prior understandings. If any provision is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. Our failure to enforce any provision shall not constitute a waiver of it. You may not assign or transfer these Terms without our prior written consent; we may assign these Terms freely.
